HB1286_L.016 SENATE FLOOR AMENDMENT Second Reading HB01-1286 Date _________ BY SENATOR Cairns Amendment No. ___________ Amend re-engrossed bill, page 1, strike lines 2 through 4 and substitute the following: "SECTION 1. 18-6-401 (6), Colorado Revised Statutes, is amended to read: 18-6-401. Child abuse. (6) A parent, guardian, or legal custodian who chooses and legitimately practices treatment by spiritual means through prayer in accordance with section 19-3-103, C.R.S., shall not be considered to have injured or endangered the child and to be criminally liable under the laws of this state solely because he fails to provide medical treatment for the child, unless such person inhibits or interferes with the provision of medical treatment for the child in accordance with a court order, or unless there is an additional reason, other than health care, to consider the said child to be injured or endangered. THIS SUBSECTION (6) SHALL APPLY ONLY TO A PARENT, GUARDIAN, OR LEGAL CUSTODIAN WHO PARTICIPATES IN TWO ONE-HOUR COUNSELING SESSIONS WHEN HIS OR HER CHILD, BORN OR UNBORN, HAS A LIFE-THREATENING CONDITION. THE COUNSELING SESSIONS SHALL INCLUDE DISCUSSIONS OF FAITH-BASED HEALING AND MEDICAL HEALING AND CARE FOR THE CHILD. BOTH COUNSELING SESSIONS SHALL BE CONDUCTED WITH ONE OF EACH OF THE FOLLOWING: (a) THE PARENT'S, GUARDIAN'S, OR LEGAL CUSTODIAN'S OWN PASTOR, PRIEST, OR CLERIC; (b) ANOTHER FAITH-BASED PASTOR, PRIEST, OR CLERIC FROM A MAINLINE DENOMINATION; AND (c) ANOTHER INDEPENDENT, AUTONOMOUS, OR NON-DENOMINATIONAL FAITH SOURCE REPRESENTATIVE.".
