R03-0967.01 Bob Lackner HCR03-1011 HOUSE SPONSORSHIP Lee, SENATE SPONSORSHIP Cairns, House Committees Senate Committees State, Veterans, & Military Affairs HOUSE CONCURRENT RESOLUTION 03-1011 SUBMITTING TO THE REGISTERED ELECTORS OF THE STATE OF COLORADO AN AMENDMENT TO SECTION 7 OF ARTICLE V OF THE CONSTITUTION OF THE STATE OF COLORADO, CONCERNING THE ABILITY OF THE GENERAL ASSEMBLY TO CALL ITSELF INTO SPECIAL SESSION, AND, IN CONNECTION THEREWITH, IN THE EVENT OF A DECLARATION OF A DISASTER EMERGENCY BY THE GOVERNOR, AUTHORIZING THE GENERAL ASSEMBLY TO CALL ITSELF INTO SPECIAL SESSION BY WRITTEN REQUEST OF A MAJORITY OF THE MEMBERS OF EACH HOUSE TO THE PRESIDING OFFICER OF EACH HOUSE TO CONSIDER ONLY THOSE SUBJECTS RAISED BY THE GOVERNOR'S DECLARATION. Resolution Summary (Note: This summary applies to this resolution as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) In the event of the declaration of a disaster emergency by the governor by executive order or proclamation in accordance with state law, modifies the existing ability of the general assembly to call itself into special session, currently authorized by written request by 2/3rds of the members of each house to consider the subjects specified in the request, to allow the general assembly to call itself into special session upon written request by a majority of the members of each house to the presiding officer of each house to consider only those subjects raised by the governor's declaration. Be It Resolved by the House of Representatives of the Sixty-fourth General Assembly of the State of Colorado, the Senate concurring herein: SECTION 1. At the next election at which such question may be submitted, there shall be submitted to the registered electors of the state of Colorado, for their approval or rejection, the following amendment to the constitution of the state of Colorado, to wit: Section 7 of article V of the constitution of the state of Colorado is amended to read: Section 7. General assembly - shall meet when - term of members - committees. The general assembly shall meet in regular session at 10 a.m. no later than the second Wednesday of January of each year. The general assembly shall meet at other times when convened in special session by the governor pursuant to section 9 of article IV of this constitution or by written request by two-thirds of the members of each house to the presiding officer of each house to consider only those subjects specified in such request; EXCEPT THAT, IN THE EVENT OF A DECLARATION OF A DISASTER EMERGENCY BY EXECUTIVE ORDER OR PROCLAMATION OF THE GOVERNOR IN ACCORDANCE WITH STATE LAW, THE GENERAL ASSEMBLY SHALL MEET UPON WRITTEN REQUEST BY A MAJORITY OF THE MEMBERS OF EACH HOUSE TO THE PRESIDING OFFICER OF EACH HOUSE TO CONSIDER ONLY THOSE SUBJECTS RAISED BY THE GOVERNOR'S DECLARATION. The term of service of the members of the general assembly shall begin on the convening of the first regular session of the general assembly next after their election. The committees of the general assembly, unless otherwise provided by the general assembly, shall expire on the convening of the first regular session after a general election. Regular sessions of the general assembly shall not exceed one hundred twenty calendar days. SECTION 2. Each elector voting at said election and desirous of voting for or against said amendment shall cast a vote as provided by law either "Yes" or "No" on the proposition: "AN AMENDMENT TO SECTION 7 OF ARTICLE V OF THE CONSTITUTION OF THE STATE OF COLORADO, CONCERNING THE ABILITY OF THE GENERAL ASSEMBLY TO CALL ITSELF INTO SPECIAL SESSION, AND, IN CONNECTION THEREWITH, IN THE EVENT OF A DECLARATION OF A DISASTER EMERGENCY BY THE GOVERNOR, AUTHORIZING THE GENERAL ASSEMBLY TO CALL ITSELF INTO SPECIAL SESSION BY WRITTEN REQUEST OF A MAJORITY OF THE MEMBERS OF EACH HOUSE TO THE PRESIDING OFFICER OF EACH HOUSE TO CONSIDER ONLY THOSE SUBJECTS RAISED BY THE GOVERNOR'S DECLARATION." SECTION 3. The votes cast for the adoption or rejection of said amendment shall be canvassed and the result determined in the manner provided by law for the canvassing of votes for representatives in Congress, and if a majority of the electors voting on the question shall have voted "Yes", the said amendment shall become a part of the state constitution.
