After consideration on the merits, the Committee recommends the following:

SB01-070 be amended as follows:

Amend printed bill, page 2, line 8, strike "obtain";
strike lines 9 through 24 and substitute the following:

"verify that the law enforcement agency for the jurisdiction has obtained a set of fingerprints for the purpose of running a criminal history background check on the person.

(2)  Prior to the release of any person from custody, the law enforcement agency having custody of the person shall check all law enforcement data bases to determine if there is an outstanding warrant for the person. If the check reveals that there is an outstanding warrant for the person's arrest, the law enforcement agency having custody shall notify the law enforcement agency for the jurisdiction in which the arrest warrant was issued and, if requested, shall hold such person in custody until the person is transferred to the custody of the law enforcement agency in the jurisdiction in which the arrest warrant was issued."
